Pesticide Product Registration

A pesticide is any substance that prevents, destroys, repels or mitigates any pest, is a plant regulator, defoliant or desiccant. These include herbicides, fungicides, insecticides, rodenticides, antimicrobials etc. Pesticides that are manufactured, sold, stored and/or transported into and through Alabama must be registered.

Registration Instructions

The current fee for new-product registrations for is $600.00 per product for a two-year registration. However, Alabama does not prorate fees. Therefore, at any time you submit a new product application you only receive the remaining time on your cycle. Currently, all products from companies A-M (and also companies that start with a number) will expire on December 31, 2025, and all products for companies N-Z will expire on December 31, 2026.

Federally Registered Products (Section 3)

Any product registered with EPA must also be registered in Alabama before it can be distributed in the state. We require separate registrations for each product’s primary and alternate brand name. The brand names to be registered in Alabama must be exactly the same as the brand name registered by US EPA and the same as on the product labeling.  Required supporting documents to register Section 3 products include: product label, safety data sheet, EPA stamped label and 8570-5 supplemental distribution form (if applicable).

Federally Exempted Products (Section 25b)

Under Section 25(b) of FIFRA, products which meet several conditions may be exempt from EPA registration. However, these minimum risk products are required to be registered with the State of Alabama.  Separate registrations are required for each product name and alternate brand name that will be distributed in Alabama. Pesticide Product Registration

New Product Registration Checklist
  1. Portal Sign in instructions (please contact pestprodreg@agi.alabama.gov).
  2. Submit your digital application(s), including:
    • Product name
    • EPA Reg # (for Section 3 products)
    • EPA Est # (for Section 3 products)
    • Color/Fragrance/Pet Weight (if applicable)
    • Active ingredients and percentages (and inert ingredients and percentages for 25b)
    • Pdf of required documents
Registration Renewal

Products expire on December 31 of any given year (odd years for A-M companies and even years for N-Z companies).  Registration renewals become available on November 1st prior to expiration. A late fee is applied to each product if renewals are not submitted by March 1st. A penalty fine will be applied instead of the late fee if renewals are not submitted by April 1st.

Discontinue

Alabama does not have a discontinuance policy for pesticide products. A product that is currently registered with the department must continue to be registered as long as it remains in the channels of trade in the state.

Revised Product Labels

The following changes require new registrations as they are not considered an update, amendment, or revision.

  • Any changes to the original registered product / label (name or logo, EPA Reg #)
  • Any change to the company name / ownership (including LLC, LTD, INC, etc.)
  • Any changes to the ingredient(s) (active and/or inert)
  • Any changes to the signal word/toxicity class
  • Changes in classification between restricted and general use.

If any of the following is added to the original product it must be registered separately: Kit, pak/pack, multi-pack, value pack, twin pack, combo/combination pack, pallet, pallet pak/ pack, cube, cube pack, season pak/pack. This falls under our multi-pack policy.

Changes mandated by EPA do not require new registration when appropriate documentation is provided.

Alabama Special Local Need (Section 24C)

Under Section 24(c) of FIFRA, Alabama can approve an additional use of a federally registered pesticide product to meet “special local needs.” These registrations are reviewed by US EPA which may disapprove the Alabama registration for the special use if, among other things, the use has been previously denied, disapproved, suspended, or canceled by US EPA. Alabama may only approve these additional uses if the product’s composition warrants the proposed claims for it, and it will perform its intended function without unreasonable adverse effects on the environment.

Experimental Use Permits (Section 5 EUPS)

Under Section 5 of FIFRA, EPA may authorize the distribution and sale for testing purposes by issuing an Experimental Use Permit (EUP).

Emergency Exemptions (Section 18)

Under Section 18 of FIFRA, EPA may allow Alabama to permit the unregistered use of a pesticide in a specific area for a limited time if emergency pest conditions exist. Usually these exemptions are used when agricultural growers and others encounter a pest problem on a site for which there is either no registered pesticide available, or for which there is a registered pesticide that would be effective but is not yet approved for use on that particular site. Please contact our office for additional information about Emergency Exemptions.

Conditions for 25(b) Minimum Risk Pesticides

This list is for guidance purposes and does not guarantee that the product will be accepted.

  • Condition 1: The product’s active ingredients must only be those that are listed in 40 CFR 152.25(f)(1).
  • Condition 2: The product’s inert ingredients may only be those that have been classified by EPA as:
    • Listed in 40 CFR 152.25(f)(2)
    • commonly consumed food commodities, animal feed items, and edible fats and oils as described in 40 CFR 180.950(a), (b), and (c); and
    • certain chemical substances listed under 40 CFR 180.950(e).
  • Condition 3: All of the ingredients (both active and inert) must be listed on the label. The active ingredient(s) must be listed by label display name and percentage by weight. Each inert ingredient must be listed by label display name.
  • Condition 4: The product must not bear claims either to control or mitigate organisms that pose a threat to human health, or insects or rodents carrying specific diseases.
  • Condition 5: The name of the producer or the company for whom the product was produced and the company’s contact information must be displayed prominently on the product label.
  • Condition 6: The label cannot include any false or misleading statements.

  • Does Alabama require pesticides classified by the US EPA as Minimum Risk Pesticides (25b) to be registered?
    • Yes
  • Does Alabama require different scents, colors, or animal weight ranges to be registered?
    • Yes, products with varying scents, colors or intended for specific animal weights need to be registered individually.
  • Do all of the different container sizes of my pesticide need to be registered?
    • No, given that only the Net Contents change. If the product name and or the directions of use change, it must be registered separately.
  • Are Manufacturing Use Pesticides (MUP’s) required to be registered in Alabama?
    • Yes
  • Are Pesticide Devices required to be registered in Alabama?
    • No
  • Does Alabama register adjuvants or pesticide additives?
    • No
  • Does Alabama require FIFRA Section 2(ee) recommendations to be submitted?
    • Yes. Section 2(ee) recommendations can be submitted via the Pesticide Product Portal.
  • Does Alabama require combination fertilizer/pesticide products to be registered?
    • Yes, these type of pesticide products must be registered in accordance with USEPA’s PPLS system. Any fertilizer product meeting the definition of a specialty fertilizer must be registered as such in addition to the pesticide registration.   • How can I submit revised labels to Alabama?
    • Labels can be submitted via the Pesticide Product Portal.
  • How will I know my product(s) have been approved after submitting and application to Alabama?
    • Once an application has been submitted, a receipt of payment will be e-mailed. Once the application has been approved, a Certificate of Registration will also be e-mailed. The certificates are also viewable in the portal.
  • If my company is based outside of the US, can I register products in Alabama?
    • Yes, but foreign registrants must designate a US based agent to represent the registrant in matters concerning their pesticide product registration application, renewal and product maintenance.
  • When is my pesticide product required to be registered in Alabama?
    • Any product that is manufactured, sold, stored and/or transported into and through Alabama must be registered. The only exception to this is if the product is manufactured in Alabama, but does not leave the facility it’s manufactured in, then it does not need to be registered.
